Bus Accident Legal Assistance

While victims of bus accidents have legal rights, and can often be entitled to compensation, insurance firms that represent bus companies will do everything they can to protect their own bottom line. This means they may delay paying on claims, or make settlement offers that do not even begin to cover a victim’s pain and suffering, medical bills and lost wages. When a victim refuses to accept an unfair settlement, the insurance company may put a lawyer on the case, purely with the intent of intimidating a victim into accepting a frugal settlement offer. That is why it is important that victims and their families have a bus accident lawyer on their side to protect their legal rights.

Dealing with a bus company, government entity or the insurance company after a bus accident is nothing like dealing with an incident involving a private passenger car. A victim dealing with a devastating injury, or a family grieving over a loved one lost to a bus accident is generally ill-equipped to deal with what lawyers representing a bus company are prepared to throw at them. The insurance companies and attorneys hired by a bus company are not interested in making sure that victims are compensated fairly. They are only interested in protecting their profits. However the compassionate and experienced car accident lawyers- New York at Parker Waichman LLP work hard to make sure our clients are treated with the fairness they deserve.

Bronx Bus Crash Kills 15

The driver of a World Wide Tours bus was involved in a serious accident at approximately 5:30am on March 12th 2011. The tour bus was returning from Mohegan Sun Casino in Connecticut to Manhattan’s Chinatown with over 30 passengers on board. The Bronx bus accident occurred at the interstate exit for the Bronx zoo on the I-95 when the bus swerved, flipped over and crashed into an exit sign. The exit sign pole came right through the front of the bus, ripping through the seats and pulling off the roof whilst causing a number of fatalities amongst the passengers.

13 passengers were pronounced dead at the scene of the Bronx bus accident and a further 19 were hospitalised; 6 of which were considered to be in critical condition. 14 died that day and the fifteenth victim was a 70 year old man who later died as a result of his injuries. The driver of the tour bus, who suffered non- life-threatening injuries, claims that he was clipped by a tractor trailer which caused him to swerve into the Hutchinson Parkway exit post which ripped the bus apart. However, according to police a number of witnesses have told investigators that the bus was moving at a ‘high rate of speed.’

According to State Police Major Michael Koppy the authorities are interviewing the bus driver and treating the investigation as a criminal matter. The tractor-trailer driver has also been interviewed but nobody has yet been charged.

Two U.S state officials have also uncovered information showing that the bus driver, Orphadell Williams, should not have been allowed to drive the vehicle as his license had been suspended in 1995 due to his failure to respond to two tickets. Evidence also shows that Williams has served two years in prison for manslaughter and has numerous convictions for theft.

Governor Andrew Cuomo has since launched a state investigation into how Williams was able to obtain a valid commercial drivers’ license. The case remains under investigation.

Liability in Bus Accidents

Bus crashes can be very complex matters and liability can be a difficult issue to confront. Bus accidents entail liability issues that are different from standard auto traffic accidents. Buses may be owned by government agencies, companies, private individuals or corporations. When addressing liability of private companies, New York State considers the owner or owners of a bus to be “common carriers”. Under most state laws, common carriers have a higher level of responsibility to drive with the utmost care and protect the passengers and other vehicles sharing the road. In some cases, this means that establishing liability against a common carrier is relatively easy as their negligence is easier to prove. If you have been involved in a bus crash and need legal advice, fill out our online form today to receive a free consultation from one of our car accident lawyers New York(Long Island).

Causes of Bus Accidents

new york bus crash lawyer, bus accident lawyer, bus crash attorneyThere are many reasons for bus accidents. Buses are so large and heavy, they can be difficult to drive. Inexperienced or poorly trained drivers have been a major factor in many bus accidents. Drivers who are overly tired or distracted have also been the cause of some bus accidents. Other factors, like poor road conditions, overloaded buses and the absence of safety equipment on a bus can also cause or contribute to bus accident injuries. The bus accident lawyers at our firm are committed to the idea that no victim of such a tragedy should have to pay for the negligence of another party.

If you happened to get into a bus accident in one of the NY boroughs (the most dangerous ones are Manhattan, Long Island and Bronx), our injury lawyer will handle any type of your bus accident claim.
